I don't really understand why countries would want to be signed up to such a thing given the potential sueing issue - which will take place in some kind of arbitration court which isn't even the international courts, it's something outside of that. Which seems mad.

It's not like things haven't already happened as a result of similar agreements - fracking companies in canada (lone pine in quebec), which i think is ongoing at the moment?
