Hmmm... this is a tricky area, isn't it. And brings us back to Mocmadmic's dilemma. Isn't having the tunes available to be heard a way of advertising them on behalf of the rights owners? Presumably, people who like a song will then go out and buy it. They won't if they don't get to hear it somewhere.

YouTube is like a radio station, in that way. However, despite the fact that the number of plays can be logged, the trouble in the case of YouTube is the fact that how many times a recording gets played is out of the hands of the people running the site. It's ours; us lot viewing it. Radio stations decide on playlists and submit them to whoever collects the monies.

YouTube would die on it's arse if it suddenly became a paid subscription site. I think some sort of ruling needs to be made, as this is all new technology which previous laws can't be applied to.
