Been dipping into and savouring this great Cherry Red comp 'The Outside of Everthing' I recently had fer my birthday and was surprised to hear what I thought was a different version of Death in Vegas song 'Dirge' off the Cantino Sessions album (seeing as it's a post punk comp ending supposedly in 81').
Only when the lyrics kicked in did I realise it wasn't DIV. So grabbing the booklet/tracklist I was surprised to find it was a band called Another Reason with a track called 'Five or Six' from a single from 1981. I know DIV nicked a few 'Berlin School' tricks and refrains on their other Album Satan's Circus. So you gotta start asking, how many other songs has Richard X nicked from big time over the years?

Well, they had to credit Pictures Of Matchstick Men on Scorpio Rising for a start.

I guess the whole 'borrowing' other people's music to create your own began with hip-hop and I'm sure there are earlier examples dating back before then. Everyone probably has a different opinion on whether it is right or wrong/clever or just ripping someone else off but around that time in so-called dance music it was so common to use gigantic chunks of others work. Some of it is cleverly done while other times I don't think there is much talent involved whatsoever. He had a huge hit and probably made loads of money with it but surely what Norman Cook did to this song (i.e. just using the vocal and slapping a dance beat underneath) is not really that clever.

I got no problem wit folks sampling or approriating tunes (hell, going back, the whole 60's invasion was built on it), and my years of lofi house acid parties would have been dull without, but it was just the (to me) apparent blatantness of it in this instance.

What is the writing credit on Dirge? I can't find that online.

The Scorpio Rising thing, I can see why that went to court. But, this is Optimo/White Lines.

They just credit themselves on my CD...recorded at Cantino Rooms etc....
I realise there is that 17 second sample allowance before royalties have to be paid, but the theiving bugger has almost lifted the other song wholsale. As you say, it's probably just a DJ thang, but it's a bit cheesy to not even give a credit, esp as Dirge was one of their better known singles, plus if you look on the Cd single you get the usual legal speak, ' all rights reserved etc....' cheeky fuckers ;) Kinda reminds me of that Father Ted Eurovision episode, keep quiet, no-one will know....

According to the DIV page in Wikipedia:

"Dirge" was the subject of a lawsuit by the band Five or Six, as it borrowed extensively from their song "Another Reason". The matter was settled with Five or Six receiving a writing credit.

Indeed, the most recent reissues apparently credit the writers of Another Reason, see

Thanks fer the info, didn't tink to wiki it. My CD is from it's original release, so tre-old, no credit on that. Lets hope Five or Six got a decent pay out. Course, Elastica were probably the biggest song nickers, two or three payouts was it?
