Re: Phil Lockwood's trial news
Feb 26, 2001, 21:55
I just spoke to Phil and he's applying for an appeal. Being a Crown Court case, he has to have very definite grounds (new evidence, judge misdirecting the jury, etc). He's saying several things, primarily that he was forced to represent himself because his barrister dropped out at an hour's notice and - after 14 months of the stress of this case - he couldn't face another adjournment.

The good news is that his barrister is no longer ill and is keen to represent Phil at the sentencing and for the appeal. The probation officer (who recommends sentence) is also very on-side.

The judge said that he doesn't want to give a custodial sentence, and he cannot give Community Service (because Phil is on the sick), so it's either a fine or, hopefully, a conditional discharge (or even an Absolute discharge).

No date has been set for sentencing, but it's likely to be late March.

Phil is still very distraught at the verdict, but is also strengthened by the public support and is very determined to fight all the way.
